JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners are accused in connection with Banmankhi P.S. Case No. 183 of 2016, registered under Sections 147, 148, 149, 447, 341, 323, 324, 307, 379, 504, 506 and 302 of the Indian Penal Code.

No.6220 of 2017 (2) dt.07-03-2017 2/3 The accusation is that Soyeb Alam, father of the informant was returning to his house from the shop of Munna, then in the way, 24 persons, including the petitioners reached near the father of the informant and surrounded him and started to abuse. At that time, Tahshil and others caused injury through lathi, stick, sword and Garasa at the head of father of the informant. When informant and his brother reached to save Soyeb Alam, father of the informant, then they were also assaulted. Thereafter, injured Soyeb Alam died on 15.11.2016. Learned counsel for the petitioners submits that only one swelling injury was found on the left parietal temporal region and occipital bone of Soyeb Alam with bleeding at left ear and dried blood was also found on the mouth.
Further submission is that specific allegation is only against Tahsil, who caused head injury to the father of the informant. Further submission is that there are general and omnibus allegations against the petitioners. Further submission is that petitioner No. 1 to 4 are in custody since 19.11.2016 and petitioner Nos. 5 to 17 are in custody since 06.12.2016.
Having regard to the facts and the circumstances of the case, the petitioners, above named, are directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten
Patna High Court Cr.Misc. No.6220 of 2017 (2) dt.07-03-2017 3/3 Thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in connection with Banmankhi P.S. Case No. 183 of 2016.
