ANJANA MISHRA ORAL ORDER 26-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 16.05.2016 in connection with Shambhuganj P.S. Case No. 22 of 2018, registered for the offence under Section 392 of the Indian Penal Code and subsequently Section 411 of Indian Penal Code has been added.
Learned counsel for the petitioner submits that though the petitioner is not named in the FIR, the name of the petitioner surfaced in course of investigation on the basis of the statement made by one Jitu @ Jitu Mandal @ Jitendra Kumar, who was arrested on suspicion and confessed his guilt. It is in the confessional statement made by Jitu @ Jitu
Patna High Court CR. MISC. No.56349 of 2019(2) dt.26-09-2019 2/2 Mandal @ Jitendra Kumar that the petitioner has been implicated in the present case. It has further been submitted that the petitioner has still not been put on T.I. Parade nor has anything been recovered from his conscious possession. Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Sub-Divisional Judicial Magistrate, Banka, in connection with Shambhuganj P.S.
