The petitioner seeks bail in Chausa (Fulaut) P.S. Case No.173 of 2016 instituted for the offence under Sections 363, 366A and 120B/34 of the Indian Penal Code.
It is alleged by the informant that his minor daughter Raunak Khatoon aged about 12 years was kidnapped by this petitioner and co-accused Bablu Yadav. The victim girl, on recovery, gave statement under Section 164 Cr.P.C. where she has not leveled any allegation against this petitioner. She has merely stated that this petitioner brought her on motorcycle and thereafter she went to different place.
In the aforesaid facts and circumstances of the case, considering the statement of victim girl recorded under Section
Patna High Court Cr.Misc. No.4355 of 2017 (2) dt.10-02-2017 164 Cr.P.C., let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Udakishunganj, DistrictMadhepura in connection with Chousa (Fulaut) P.S. Case No.173 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
