The petitioner seeks bail in Benipatti P.S. Case No. 67 of 2021 corresponding to Sessions Trial No. 211 of 2021, registered for the offence punishable under Sections 307, 302 and other allied sections of the Indian Penal Code and section 27 of the Arms Act.

It is submitted on behalf of the petitioner that petitioner is not named in the FIR. During course of investigation, name of this petitioner surfaced in this case on his own confession before the police. Petitioner has been made accused in this case only because he was in constant touch with co-accused Pravin Jha on the date of occurrence and his motorcycle was found parked near the house of co-accused Rajesh Kumar Jha. Petitioner is in custody since 16.04.2021.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge V, Madhubani in connection with Benipatti P.S. Case No. 67 of 2021 corresponding to Sessions Trial No. 211 of 2021.
