The petitioner seeks bail in connection with Banka Excise Case No. 107 of 2021 arising out of Prohibition Case No. 155 of 2021 instituted for the offences under Section 30(a) of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 09.10.2021, is a person with clean antecedent and prosecution report has been submitted in the case.

Learned counsel for the petitioner submits that the allegation is of recovery of 990.300 litres of liquor from a pickup van and petitioner was arrested along with Ranjeet

Learned counsel for the petitioner submits that the petitioner was the driver of the vehicle and as such was not knowing what was kept by the owner in the vehicle. Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 09.10.2021, is a person with clean antecedent and chargesheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II, Banka in connection with Excise Case No. 107 of 2021.
