The petitioner apprehends his arrest in Jamui P.S. Case No. 105/2016, registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code. The informant, Rajendra Pandey, named the petitioner along with other accused persons and alleged that while he was constructing house the petitioner objected him. The petitioner alleged to have assaulted the informant with Khanti on his head. Other accused persons are alleged to have assaulted the informant and others.
It is submitted that there is a land dispute between the parties. From the side of petitioner Jamui P.S. Case No. 106/2016 is registered. Both sides got injuries. Informant's side got two
Patna High Court Cr.Misc. No.39725 of 2016 (2) dt.20-09-2016 2/2 injuries, one found lacerated over head and the second injury is abrasion on the anterior part of the leg. Both injuries are simple in nature.
Considering the facts aforesaid and the fact that there is a case and counter case and on account of assault injuries caused to the informant which are simple in nature, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui in connection with Jamui P.S. Case No. 105/2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) Rakhi U T
