The petitioner is apprehending arrest in connection with Birpur P.S. Case No. 319 of 2013 for offences under Sections 269, 274, 275, 120(B) IPC and 27(b)(ii) and 28A of Drugs and Cosmetics Act, 1914. Allegation against the petitioner is that he was engaged in trade of medicines without valid licence. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. With reference to Annexure-3 he submits that the petitioner has valid licence. He further submits that no intoxicant substance was found in the medicine seized from the premises of the petitioner. In fact, the IO of the case, after investigation, has found the case false

Patna High Court CR. MISC. No.70239 of 2019(4) dt.05-03-2020 2/2 against this petitioner yet differing from that report, the court below took cognizance against the petitioner also. Considering the aforesaid, let the petitioner, above named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 50,000/- (Fifty Thousand) with two sureties of the like amount each to the satisfaction of the SDJM, Birpur in connection with Birpur P.S. Case No. 319 of 2013, subject to the conditions as laid down under Section 438(2) Cr. P. C.
