JUSTICE RAVI RANJAN ORAL ORDER 13-03-2015 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered for the offences punishable under Sections 341, 323, 504, 354, 379, 307/34 of the Indian Penal Code. It is submitted that, in the first information report, there is general and omnibus allegation against all the persons. However, during course of investigation some of the persons made allegation that the petitioner had assaulted by iron rod on the head of the informant. It is contended that the informant is the eye witness and had received injury also, and, as such, had he been given such blow by the petitioner he ought to have stated in the first information report regarding the alleged assault by the petitioner. Thus, it is urged that the subsequent allegation is an after thought. It is further stated that though the petitioner is also

Case No.299 of 2004 under Sections 25(1-b)a, 26/35 of the Arms Act, however, that case was lodged about ten years back. That apart, it is also contended that other accused persons, namely, Tarchand Yadav, Kalanand Yadav and Giranand Yadav have already been granted anticipatory bail by the Sessions Judge.

Having regard to the facts and circumstances of the case, let the abovenamed petitioner, namely, Satto Yadav, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Forbesganj (Simraha) P.S. Case No.514 of 2013 on furnishing bail bonds of Rs.10,000/- (Ten Thousand Rupees) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
