This is an application for bail in connection with Sitamarhi P.S.Case No. 544 of 2016 registered for the offences punishable under Sections 394, 395 and 412 of the Indian Penal Code.

It has been submitted on behalf of the petitioner that petitioner is not named in the FIR and there is alleged recovery of some ornaments from the possession of the petitioner but the same are domestic articles of the petitioner and he has remained in custody since 20.10.2016.

Heard learned APP also, who has opposed the prayer for bail.

Having heard both sides and in view of the fact that

Patna High Court Cr.Misc. No.6969 of 2017 (3) dt.17-03-2017 2/2 there is recovery of huge quantity of ornaments from the possession of the petitioner and he is accused in other case also, I am not inclined to grant bail to the petitioner at this stage. However, trial court is directed to expedite the trial and try to conclude it within a period of nine months. If the trial is not concluded within the said period the petitioner will be at liberty to renew his prayer for bail.

Accordingly, this application is dismissed.
