====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 24-12-2013 Heard learned counsels for the petitioners and the State.

The petitioners being the husband and brother of the husband of the victim are apprehending their arrest in a case registered for the offences punishable under Section 304(B)/34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant within one year of marriage for nonfulfillment of dowry demand. It is submitted that the victim died due to burn injury when the informant has retracted from her initial version and filed a petition to that effect before the learned court below.

Considering the nature of accusation, let the learned court below consider regular bail of petitioner no.1 Vipin Rai who is the husband of the victim if he surrenders within a period of six weeks

Patna High Court Cr.Misc. No.39330 of 2013 (2) dt.24-12-2013 2 / 2 from the date of receipt of copy of this order in connection with Kanti P.S. Case No. 134 of 2013 pending in the court of the learned S.D.J.M., West, Muzaffarpur.

With this observation, the application of petitioner no.1 is disposed off.

Considering the nature of accusation against petitioner no. 2 and retracted version of the informant, let him except petitioner no.1 above named, be released on bail in the event of arrest or surrender before the learned court below within a period of twelve weeks from today in connection with Kanti P.S. Case No. 134 of 2013 on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., West, Muzaffarpur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
