The petitioners prayed for regular bail in connection with Gardanibagh P.S. case No. 548 of 2023 instituted for the offence under Sections 30(a), 32(2)(3), 36, 41(i)(ii) of the Bihar Prohibition and Excise Act.

Prosecution case relates to recovery of total 599 liters of illicit liquor from a public but and the petitioners are said to have indulged in illicit trade of liquor.

Learned counsel appearing on behalf of the petitioners has submitted that petitioners are innocent and have committed no offence. They has falsely been implicated in this present

Patna High Court CR. MISC. No.61517 of 2023(2) dt.22-09-2023 2/2 case. Petitioners have no concern with the alleged recovery or with the bus in question. No any incriminating article has been recovered from their possession. The petitioners are languishing in judicial custody since 28.7.2023.

Learned APP appearing for the State has vehemently opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioners, this court is inclined to enlarge them on bail. The above named petitioners are directed to be released on bail in connection with Gardanibagh P.S. Case No. 548 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge Excise, Patna.
