JUSTICE ARUN KUMAR ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the State. Petitioner is languishing in custody in connection with a case registered under Sections 30(a) and 38(1) of the Bihar Prohibition and Excise Act.
The allegation, in brief, is that the police raided a local Tea Shop of co-accused, namely, Pradip Paswan, and recovered some illegal country made liquor and thereafter also raided the house of the petitioner and seized 65 bottles of Saufi Nepali wine each containing 300 Ml.
It is submitted that several persons live in the house and he has been in custody since 22.12.2016 and has got no any criminal antecedent.

No.6145 of 2017 (3) dt.09-02-2017 2/2 Considering the aforesaid facts and circumstances, the petitioner, namely, Ajay Patel, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Shikarpur P.S. Case No. 536 of 2016.
