This is an application for bail in connection with Bahadurpur P.S.Case No. 389 of 2016 registered for the offences punishable under Sections 279, 304 and 304A of the Indian Penal Code.

It has been submitted on behalf of the petitioner that though petitioner was driving tractor in drunken condition and dashed two ladies, who were declared dead in hospital, but he has no intention to kill them, which is of accidental death and petitioner is in custody for more than four months. Heard learned APP also.

Having heard both sides and considering the nature of allegation, I am not inclined to grant bail to the petitioner at this

Patna High Court Cr.Misc. No.10518 of 2017 (2) dt.21-03-2017 2/2 stage.

However, learned trial court is directed to expedite the trial of the petitioner and try to conclude the same within seven months. If the trial is not concluded within the said period the petitioner will be at liberty to renew his prayer for bail before the court below, who will pass appropriate order, without being prejudiced by this order, on the basis of materials available on record at that time.

Accordingly, this application is dismissed.
