Petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 341, 323, 324, 326, 307/34 of the Indian Penal Code. It is submitted on behalf of the petitioners that from the First Information Report itself that there is specific allegation of assault upon the co-accused, namely, Rahul and Vinai whereas the petitioners have stated to be either members of the mob or order giver. Petitioners have stated that they are having fair antecedents.

No.39487 of 2014 (2) dt.13-03-2015 2/2 Having regard to the facts and circumstances of the case, let the abovenamed petitioners, namely, Yogendra Kapar, Ramadhar Kapar, Ram Pawiter Kapar @ Ram Pabitar Kapar, Raushan @ Raushan Kumar and Ram Anek Kapar @ Anek Kapar, be released on bail in the event of arrest/surrender before the court below within a period of six weeks from today in Sonbarsa P.S. Case No.61 of 2014 on furnishing bail bonds of Rs.10,000/- (Ten Thousand Rupees) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi, subject to the conditions laid down under sub-section (2) of Section 438 of the Code of Criminal Procedure.
