The petitioner seeks bail in Parbatta (Maraiya) P.S. Case No. 274/2016, registered for the offences punishable under Section 392 and other sections of the Indian Penal Code. The informant named two persons Dhananjay Yadav and Naresh Yadav and alleged that three persons committed robbery. The petitioner is not named in the F.I.R. Name of the petitioner figured in the case during the course of investigation from the mouth of the witnesses. Nitya Nand Singh and Birendra Singh are said to have disclosed that the petitioner was also along with Dhananjay Yadav and Naresh Yadav on Horse. The petitioner was apprehended, but he was not put on Test Identification Parade. No looted article was recovered from the possession of the petitioner.

Patna High Court Cr.Misc. No.12375 of 2017 (2) dt.20-03-2017 Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate Ist, Khagaria in connection with Parbatta (Maraiya) P.S. Case No. 274/2016.
