Heard the learned counsel for the petitioners and learned APP for the State.

The petitioners apprehend their arrest for the

Patna High Court CR. MISC. No.71259 of 2021(2) dt.29-07-2022 2/3 offences alleged under Sections 147, 149, 323, 308 and 504 of the Indian Penal Code, registered in connection with Birpur P.S.Case No. 11 of 2016.

As per allegation, the petitioners badly assaulted the members of the informant's side and made them injured. The occurrence is stated to have taken place due to dispute relating to partition of properties.

The learned counsel for the petitioners has submitted that both the parties are agnates. There is case and counter case and the injury suffered by the injured persons are simple in nature and petitioners are persons of clean antecedent. Considering the above facts and circumstances, let the petitioners above-named, in the event of their arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each, with two sureties of the like amount each to the satisfaction of Sri Junaid Alam, Judicial Magistrate 1st Class, Lakhisarai in connection with Birpur P.S.Case No. 11 of 2016, subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioners within the stipulated time as provided
