JUSTICE ARUN KUMAR ORAL ORDER 28-06-2017 The petitioner is accused in Harnaut P.S. Case No.226 of 2012 wherein after investigation, police submitted charge sheet and the court below has taken cognizance under Sections 467, 468, 471, 472, 419 and 420 of the Indian Penal Code.

Learned counsel for the petitioner has challenged the quashing petition on the ground that earlier a case of similar nature was filed against the petitioner vide Ahiyapur P.S. Case no.433 of 2006 and in that case, the allegation was similar in nature relating to manipulation of documents, educational certificates, transfer certificate for securing the job of a police constable by advancing his age and the cognizance was taken but that order was challenged vide Cr. Misc. No.10602 of 2008 and this Court

Patna High Court Cr.Misc. No.39511 of 2013 (8) dt.28-06-2017 2/2 quashed the cognizance order. Now in the present case allegation is that petitioner by reduce his age by manipulation in documents has obtained post of constable. However the report of the court below shows that now the stage of case has advanced further and now fixed for hearing on the point of discharge by the petitioner, therefore, this petition for quashing is dismissed with liberty to raise grounds taken herein at hearing on point of charge.
