2. The petitioner apprehends his arrest in connection with Saharsa P.S. Case No. 300 of 2024, registered for the offences punishable under Section 27 of the Arms Act.

3. In course of patrolling the informant received information that some miscreants are engaged in firing at Polytechnic Dhala in order to terrorise the people. On the aforenoted information when the police reached there all the miscreants succeeded in fleeing away. From the nearby people and the CCTV footage, the complicity of the petitioner has transpired in making indiscriminate firing.

4. Learned counsel appearing on behalf of the petitioner contended that in fact, the name of the petitioner

No.65723 of 2024(3) dt.18-01-2025 2/3 has implicated in this case on account of his three criminal antecedents, as has been disclosed in Paragraph No. 3 of the bail application. The identification through the CCTV footage is suspicious, inasmuch, as the informant has not disclosed that who are the persons, who have said about the complicity of the petitioner in causing firing. No one has sustained any injury nor any person has made any allegation that he was threatened by the petitioner and others. The entire case is based on suspicion

5. On the other hand, learned counsel for the State opposed the bail application and submits that the petitioner bears three criminal antecedents and this clearly suggest his involvement in such kind of activities.

Regard being had to the submissions made on behalf of the parties and considering the doubtful involvement of the petitioner in the crime, based on suspicion and the disclosure made by unknown person, let the petitioner above named be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the

Case No. 300 of 2024, subject to the conditions laid down in Section 438(2) Cr.P.C. with the further condition that one of the bailors shall be the own/close family members of the petitioner.
