JUSTICE MOHIT KUMAR SHAH ORAL ORDER 22-12-2021 Though, the present petition has been filed by way of 2nd attempt at the behest of the petitioners for grant of anticipatory bail in connection with Bikram P.S. Case No. 243 of 2019 for the offence punishable under sections 467, 468, 406, 420 and 34 of the Indian Penal Code, 1860 in as much as the earlier petition of the petitioners for grant of anticipatory bail was dismissed by an order dated 17.09.2020 passed in Cr. Misc. No. 4043 of 2020, but the learned counsel for the petitioners has, at the very outset, submitted that the petitioners seek liberty to surrender before the learned court below within a period of four weeks from today, however, the learned court be directed to consider a new fact, which has been brought on record, before

No.70684 of 2021(2) dt.22-12-2021 2/2 this Court by way of Annexure-4 to the present petition, which is a complaint filed by the Secretary of the Arap Narayanpur PACS, in which the petitioners are witnesses, while considering the prayer of the petitioners for grant of bail, without being prejudiced/ influenced by dismissal of the anticipatory bail petition of the petitioner either by the learned court below or by this Court.
The learned APP for the State, Shri Parmeshwar Mehta, has got no objection.
