JUSTICE KISHORE KUMAR MANDAL ORAL JUDGMENT Date: 10-09-2015 Heard the counsel for the petitioner and Mr. Sujeet Sinha who has appeared on behalf of the respondent -Regional Passport Officer.

Petitioner having applied and filed an affidavit in support thereof was granted passport showing his date of birth as 10.05.1985. Now, he wants correction in the date of birth incorporated in the passport. In support of his claim, a matriculation certificate has been enclosed . The petitioner is, however, not able to state as to the jurisdiction of the Passport Officer to effect such correction.

On the other hand, a stand has been taken by the respondents that if a declaration of competent Court is produced showing his correct date of birth, the Passport Officer would act

Counsel for the petitioner, after making submissions at some length, states that he will move the respondent- Passport Officer to satisfy him about his power and the bonafides of the petitioner in seeking such correction in the date of birth failing which appropriate proceeding shall be instituted for declaration that his date of birth is 18.10.1989 and not 10.5.1985.

The writ application is disposed of with the aforesaid liberty.
