JUSTICE RAKESH KUMAR ORAL ORDER 07-08-2019 The sole petitioner had approached this Court by filing the present petition for granting anticipatory bail. Sri Bipin Kumar Sinha, learned Standing Counsel for the Central Bureau of Investigation (hereinafter referred to as the "C.B.I.") submits that in compliance with earlier order, the C.B.I. has already submitted final report and has also forwarded a letter to the Principal Secretary(Home), Bihar, Patna for taking action against erring police officials.

By order dated 08.12.2016, the petitioner was directed to be released on bail, in the event of his arrest or surrender within six weeks from the date of order and the petition stood disposed of. However, while disposing of the anticipatory bail petition, the C.B.I. was also directed to conduct further

Patna High Court CR. MISC. No.41248 of 2016(10) dt.07-08-2019 2/2 investigation in the case and, thereafter, the C.B.I. registered a regular case, vide RC0232017-A0009-Patna. During investigation, it was noticed by the C.B.I. that the police officials had committed serious error and, as such, while submitting final report, a detailed letter was also communicated to the Principal Secretary, Home Department, Govt. of Bihar for taking appropriate action against erring officers, namely, Sri Bipin Kumar Singh and Sri Raj Kumar Mandal, Sub Inspectors of Bihar Police.

In view of facts and circumstances, since the bail petition was earlier disposed of, there is no reason to pass further order. However, the Court expects that the Principal Secretary, Home Department, Govt. of Bihar may take appropriate steps in the light of recommendation by the C.B.I. Let a copy of the order be sent to the Principal Secretary, Home Department, Govt. of Bihar.
