The petitioner apprehends his arrest in Madan Pur P.S. Case No. 110 of 2016 instituted for the offence under Section (s) 419 of the Indian Penal Code and Section 7 of the Essential Commodities Act.

The informant has alleged that the accused persons named in the First Information Report are not entitled to food-grains under Food Security Scheme but they got food-grains from the PDS shop.

It has been submitted on behalf of the petitioner that petitioner is Panchayat Secretary. He has not issued any ration card to any beneficiaries and his name has come in the supervision

Patna High Court Cr.Misc. No.9299 of 2017 (2) dt.01-03-2017 2/2 note in para 29 of the case diary. It has further been submitted that one of the co-accused Vijay Kumar Singh has been granted bail by a coordinate Bench of this Court vide Cr. Misc. No. 48887 of 2016.

In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Madan Pur P.S. Case No. 110 of 2015, G.R. No. 1483 of 2015, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
