2. Petitioner is apprehending arrest in connection with Nokha P.S. Case No. 117 of 2025 registered for the offences punishable under Sections 191(2), 190, 126(2), 115(2), 109, 352, 351(2), 351(3), 74 of B.N.S., 2023.

3. As per prosecution case, there is allegation against the petitioner and others who are said to have assaulted the informant by means of lathi danda. It is further alleged that co-accused Amit Ram assaulted upon the head of the informant.

4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence as alleged in the first information report and he has been falsely implicated in this case. There is no specific allegation of assault against the

Patna High Court CR. MISC. No.60600 of 2025(2) dt.09-09-2025 2/3 petitioner. The allegations levelled against the petitioner are general and omnibus in nature. The specific allegation of assault upon the head of the informant is against co-accused Amit Ram. The injury sustained by the informant has been found to be simple cause by hard and blunt substance, as is evident from the Injury Report contained in Annexure-P/3. Learned counsel submits that the date of occurrence is 25.04.2025 and the present F.I.R. has been lodged on 26.04.2025 and there is no explanation for the alleged delay, which questions the authenticity of the prosecution story. Petitioner bears no criminal antecedent.

5. The learned A.P.P. for the State vehemently opposes the prayer for anticipatory bail of the petitioner and submits that petitioner's name finds place in the prosecution story and he cannot escape from the liability of the allegations levelled in the first information report.

Considering the facts and circumstances of the case, keeping in view clean antecedent of petitioner, there is no specific allegation of assault against the petitioner, argument advanced on behalf of both sides and also taking into consideration the material available on record, the petitioner, above named, in the event of arrest or surrender within a period

No.60600 of 2025(2) dt.09-09-2025 3/3 of six weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate I, Sasaram in connection with Nokha P.S. Case No. 117 of 2025, subject to the conditions as laid down under section 482(2) of the B.N.S.S.

7. The application stands allowed.
