2. The petitioner seeks bail in connection with Rohtas P.S. Case No. 113 of 2024 registered for the offence under Section 376, 506, 493 of the Indian Penal Code, under Section 4/6 of the POCSO Act and under Section 3⁄4 of the D.P. Act.
3. As per the prosecution case, the petitioner is said to have committed rape upon the victim.
4. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and from the statement of the victim girl, made under Section 161 of the
Patna High Court CR. MISC. No.66293 of 2024(2) dt.03-10-2024 2/2 Cr.P.C., it appears that this is a case of live-in relationship.
5. The petitioner is in custody since 26.3.2024.
6. Considering the aforesaid facts, this application is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, POCSO Act, Rohtas at Sasaram/concerned Court below in connection with Rohtas P.S.
