JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-06-2018 This application has been filed for modification of the order dated 9.4.2018 passed in Cr.Misc.No. 18102 of 2017 by which petitioner was granted anticipatory bail on the condition that after submission of charge sheet petitioner had to surrender and make prayer for regular bail and also modification is sought that in the said order petitioner had been mentioned as Circle Officer though he is Rajshaya Karmchari.

Submission of learned counsel for the petitioner is that as a matter of fact prior to granting bail charge sheet had already been submitted and cognizance was taken, as such, aforesaid order be modified.

Heard learned APP also.

Having heard both sides and in the facts and

Patna High Court Cr.Misc. No.31865 of 2018 (2) dt.21-06-2018 2/2 circumstances, I am not inclined to interfere with the earlier order. However, if the petitioner, who is Rajshaya Karmchari, surrenders before the court below and makes prayer for regular bail, learned court below shall consider the same on merit considering all aspects of the matter and try to dispose of the same, if possible, on the same day by passing a reasoned order.

With the above observation, this application is disposed of.
