2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 342, 307, 34 of the Indian Penal Code.
3. As per the prosecution case, when the informant was going to his house on motorcycle, the accused persons including these petitioners intercepted the informant and these petitioners caught hold of informant and co-accused Rakesh Kumar Das fired from country-made katta on the chest of informant.
4. It is submitted on behalf of petitioners that specific accusation of causing fire-arm injury is against co-accused Rakesh Kumar Sah. So far as these petitioners are concerned,
Patna High Court CR. MISC. No.65845 of 2023(2) dt.17-10-2023 2/2 they are only alleged to have caught hold of informant and there is no allegation of overt act against them. Petitioners have got clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Bettiah, West Champaran in connection with Inarwa P.S. Case No. 73 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
