JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 08-03-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew the prayer of bail which was earlier twice rejected by order dated 15.10.2015 and 27.04.2016 passed in Cri. Misc. No. 28175 of 2015 and Cri. Misc. No. 17769 of 2016, on the ground that the petitioner is suffering in custody since 03.05.2015 having no criminal antecedent and trial has not been concluded up till now and in near future it is not likely to be concluded. The I.O. has not been examined and no witness has been examined after 28.10.2016.

The learned A.P.P. opposes the prayer of bail. In the facts and circumstances stated above, finding

Patna High Court Cr.Misc. No.5804 of 2017 (3) dt.08-03-2017 2/2 no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. However, the learned trial court is again directed to expedite the trial and to conclude the same as early as possible preferably within two months, failing which if the petitioner at no fault, may be at liberty to renew her prayer for bail.
