The Petitioner seeks bail in Muffasil P.S. Case No. 76A of 2016 instituted for the offence under Section(s) 25(1)(a)/25(1-AA)/25(1-AC)/25(1-B) a 25(1-B) c/26(1)(II)(III), 35 of the Arms Act.

It has been submitted on behalf of the petitioner that petitioner has no criminal antecedent. There is no recovery of any fire arm from the possession of the petitioner. The name of the petitioner has been disclosed by co-accused Md. Gaffar from whose house fire arm and equipments for manufacturing fire arm has been recovered. It has further been submitted that Md. Gaffar has already been granted bail by a

Patna High Court Cr.Misc. No.6888 of 2017 (6) dt.02-05-2017 2/2 coordinate Bench of this Court vide Cr. Misc. No. 48440 of 2016. Learned Sessions Judge has mentioned in the impugned order that in para 31 of the case diary, the criminal antecedent of the petitioner has been revealed. The case diary has been called for. From perusal of para 31 of the case diary it appears that there is no mentioning of any criminal antecedent of the petitioner. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Munger in connection with Muffasil P.S. Case No. 76A of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
