ANJANA MISHRA ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 04.08.2019 in connection with Excise Case No.332 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is a poor labourer and the alleged recoveries were not from his conscious possession, but from the hut which does not belong to the petitioner. It is further submitted that the petitioner is not having any criminal antecedents.

Considering the aforementioned facts and circumstances and that the petitioner has clean antecedents, let
