1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner apprehends her arrest in connection with Warisaliganj P.S. Case no.140 of 2023 registered under sections 420, 419 and 379 of the Indian Penal Code and Section 66D of the I.T. Act.

3. As per the prosecution case, the informant states that the petitioner runs a Customer Service Point (C.S.P) linked to the S.B.I Branch, Warsaliganj who allegedly caused fraudulent of an amount tottaling to Rs. 23,700/- in three transactions of Rs. 10,000/- on 01.02.2023, Rs. 10,000/- on 02.02.2023 and Rs. 3,700/- on 20.02.2023 from the account of the informant.

4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the case. The allegations against the petitioner are totally incorrect and as a matter of fact no money has been withdrawn by the petitioner from her C.S.P rather the petitioner had given a petition before the Branch Manager, S.B.I, Warsaliganj regarding fraudulent withdrawal of money and the Chief Manager of S.B.I also issued a certificate wherein it was clearly stated that the alleged withdrawal from the account of the informant has been made from a different Customer Service Point and not at the outlet of S.B.I. The application of petitioner filed before the Superintendent of Police and the certificate of the S.B.I issued by the Chief Manager of S.B.I are both annexed as Annexure-3 Series to the present application.

Learned counsel for the petitioner further submits that the petitioner has been running C.S.P from the past 8 years with all honesty and integrity and would not ruin her carrier at this stage. The petitioner has no criminal antecedent and undertakes to cooperate in the case/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

6. In view of the entire facts and circumstances of the

No.71131 of 2024(7) dt.07-05-2025 3/3 case, it is directed that the petitioner, above named, in the event of her arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Warisaliganj P.S. Case no.140 of 2023 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawada, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure/Section 482(2) of the B.N.S.S, 2023.
