A supplementary affidavit has also been filed today by the petitioners stating that for the same occurrence, another case had also been filed by the informant against these petitioners in which, cognizance has been taken only for the bailable sections of the Indian Penal Code.
The petitioners apprehend their arrest in connection with Sahpur P.S. Case No. 148 of 2013 registered for the
Patna High Court Cr.Misc. No.39997 of 2014 (2) dt.25-03-2015 2/2 offences, punishable under Sections 143, 307, 323, 325, 379 of the Indian Penal Code.
Learned counsel for the petitioners submits that one of the co-accused namely, Bhim Rai had filed a case against the informant of the present case. It appears from the contents, as made in the First Information Report, that there is animosity between them, which resulted into institution of the present occurrence.
Considering the aforementioned submissions and the nature of allegation, let the petitioners, in the event of their arrest or surrender before the court below within a period of two weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Danapur, District- Patna in connection with Sahpur P.S. Case No. 148 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C..
