JUSTICE SUDHIR SINGH ORAL ORDER 10-08-2018 Heard learned counsel for the petitioner and learned counsel for the respondents.

The following reliefs have been sought for by the petitioner in the present writ application.

"1. That the present writ application is being filed for a direction upon the concerned respondents to consider the case of the petitioner for compassionate appointment in view of the fact that the father of the petitioner died in harness on 24.04.2012, while working as Assistant Teacher in the Government School, namely, High School, Gangapatti, Supaul, on any post which may include Assistant Teacher or in Class-III or ClassIV post.

Patna High Court CWJC No.12934 of 2018 (2) dt.10-08-2018 2/2 The concerned respondents, for the reason best known to them, is not placing the case of the petitioner for consideration of appointment under compassionate ground, before the District Compassionate Committee, Supaul.

Instead, the concerned respondents are seeking one direction or the other from the higher authorities as to whether the petitioner can be appointed on the post of Primary Teacher."

It has been submitted by learned counsel for the petitioner that the case of the petitioner is squarely covered by the order passed by another Co-ordinate Bench of this Court in C.W.J.C. No. 18478 of 2016 dated 06.02.2018.

The respondent no. 8, the District Programme Officer (Establishment), Supaul, is directed to examine the case of the petitioner in light of the order passed in C.W.J.C. No. 18478 of 2016 dated 06.02.2018 and pass an appropriate order in accordance with law within a period of three months from the date of receipt/production of copy of this order.

With the aforesaid observations and directions, the present writ application stands disposed of.
