The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 341, 323, 325, 307, 379, 385/34 of the Indian Penal Code.

Prosecution case is that as per FIR, the informant is the Manager of Anisul Petrol Pump and given a written report to the officer in charge Routa and stating therein that on the even date and time of the occurrence the accused persons named in the FIR came on motorcycle and took the petrol of rupees 150/- and without giving the money started to went thereafter the Assistant Rakesh Kumar given to informant to the informant in the meantime the accused persons fled away from the petrol pump and stayed in a shop then the informant reached there and demanded money thereafter, the accused persons denied to given the money and tried to flee away then informant stopped in the meantime the accused persons started

Patna High Court CR. MISC. No. 57223 of 2019(4) dt.18-11-2019 2/2 assaulting and one Jamir Anwar pushed the informant and the informant fell down due to which the informant sustained injury and also taken the money from the pocket but with the help of neighbour one person has been arrested and disclosed the names of the fled persons which is mentioned in the FIR.

Learned counsel for the petitioner submits that the petitioner has made accused on the confessional statement of Ruksheed, the name has transpired in the present case. There is no recovery from the conscious possession of the petitioner and has no criminal antecedent.

In the aforesaid facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea, in connection with Routa P.S. Case No. 27 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
