====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 06-10-2023 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners have preferred this application for grant of regular bail in connection with Gaighat P.S. Case No. 07 of 2023 dated 05.01.2023 registered for the offence punishable under Section 394 of the I.P.C.

3. As per the prosecution case, two unknown miscreants boarded on a Motorcycle came and assaulted the informant and snatched his Laptop, some bill books, diaries and

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. The petitioner no. 1 has three criminal antecedents and the petitioner no. 2 has one criminal antecedent, as stated in paragraph no. 3 of the bail petition. It is further submitted that the petitioners are not named in the F.I.R. The petitioners were arrested in connection with Bochahaon P.S. Case No. 15 of 2023 on 06.01.2023 by police with some stolen article and the police got their confessional statement recorded under threat and compulsion and only on the basis of the said confessional statement, the petitioners were remanded in the present case on 28.02.2023 and since then they are in custody.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court concerned, Muzaffarpur, in connection with Gaighat P.S. Case No. 07 of

7. The application stands allowed.
