16-01-2017 Sri Sunil Kumar Singh, learned counsel, who has appeared on behalf of opposite party/husband of the petitioner, on instruction, submits that the opposite party has got no grievance if the case is transferred from Samastipur to Madhubani. The petitioner, wife of opposite party, has prayed for directing for transferring the record of Divorce Case No. 86 of 2013 from the court of Principal Judge, Family Court, Samastipur to the court of Principal Judge, Family Court, Madhubani. The plea in the petition was taken that petitioner was ousted and she is having three years old child in her lap and due to this reason, it is difficult for her to attend regular proceeding before a court, which is about 100 km away.

Since both the parties have agreed for the transfer,

Patna High Court MJC No.4843 of 2013 (3) dt.16-01-2017 2/2 there is no difficulty in disposing the present petition. Accordingly, it is directed to transfer the record of Divorce Case No. 86 of 2013 from the court of Principal Judge, Family Court, Samastipur to the court of Principal Judge, Family Court, Madhubani forthwith.

The petition is allowed.
