The petitioner is looking for initiation of contempt proceeding by virtue of the order dated 18.04.2018 wherein while disposing off the interlocutory application under Order XXXIX Rule 1 and 2 of the Code of Civil Procedure in First Appeal No. 165 of 1996, this Court had observed that status quo in respect of the land shall be maintained.
In the opinion of this Court, if it is a case of violation of the injunction order passed by this Court sitting in its first appellate jurisdiction, the remedy lies to the petitioner in terms of order 39 Rule 2A of the Code of Civil Procedure. This
Patna High Court MJC No.3238 of 2016(3) dt.25-08-2018 2/2 contempt application cannot proceed and disposed off, accordingly, with liberty to the petitioner to seek his remedy in accordance with law.
