This is an application for bail in connection with Banka (Barahat) P.S.Case No. 99 of 2016, corresponding to Sessions Trial No. 17 of 2017, registered for the offences punishable under Sections 363 and 364 of the Indian Penal Code. It has been submitted on behalf of the petitioners that petitioners are not named in the FIR but later on the victim girl in her statement recorded under Section 364 Cr.P.C. has named these petitioners and they have remained in custody since 17.11.2016. Heard learned APP also, who has opposed the prayer for bail of the petitioners.

Having heard both sides and from perusal of the

Patna High Court Cr.Misc. No.8072 of 2017 (2) dt.27-02-2017 2/2 impugned order it appears that there are materials against the petitioners as well as the statement of the victim girl, I am not inclined to grant bail to the petitioners.

However, considering the facts and circumstances of the case, the trial court is directed to expedite and conclude the trial within a period of nine months.

With the above observations, this application is dismissed.
