Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

FIR was lodged on recovery of dead body of the son of the informant whose murder was committed with firearm. Suspicion is against Mukesh Yadav, son of this petitioner for the reason that the victim had left his house along with Mukesh Yadav, his friend.

Suspicion is against the petitioner also that for the reason that victim had love-affairs with the daughter of the petitioner. Suspicion is also against Rukesh Yadav with whom the informant has got land dispute.

Considering the fact that only material is suspicion

Patna High Court CR. MISC. No.56470 of 2019(2) dt.09-09-2019 2/2 which is not only against the petitioner, rather against others also for different reasons, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bihra Police Station Case No. 55 of 2019, subject to the following conditions:- (a) The petitioner shall fully cooperate with the investigation/trial of the case, failing which the learned court below shall be at liberty to cancel the bail bond of the petitioner. (b) Both the bailors shall be resident of the territorial jurisdiction of the learned court below.
