JUSTICE SANJAY PRIYA ORAL ORDER 14-02-2017 Heard learned counsel for the petitioner, learned counsel for the informant and the State.

The petitioner seeks bail in a case instituted for the offence under Sections 302, 120B and 34 of the Indian Penal Code.

It has been submitted that the petitioner is maternal father-in-law of the deceased. There is general and omnibus allegation against the petitioner.

During hearing of the bail petition, the photocopy of the case diary has been produced before this Court by the counsel for the informant. The witnesses in the case diary have merely raised suspicion against the petitioner. There is no specific overt act alleged against the petitioner. From perusal of the inquest

Patna High Court Cr.Misc. No.4557 of 2017 (2) dt.14-02-2017 2/2 report, it appears that the death of the deceased was caused due to the injuries on his person.

From the written report itself it appears that there is general and omnibus allegation against the petitioner. It has been submitted on behalf of the learned counsel for the informant that the witnesses have supported the case in the case diary and taken the name of the petitioner. The learned A.P.P. has also opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Naugachhia, Distt. Bhagalpur, in connection with Kharik P.S. Case No. 132 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
