This application is for grant of bail in connection with Sherghati P.S.Case No.129 of 2016 for the offence under Sections 387 of the Indian Penal Code and Section 17 of the Criminal Law Amendment Act.

It is submitted on behalf of the petitioner that the petitioner has been made accused on the basis of suspicion as well as on the confessional statement of the co-accused, except that there is nothing against the petitioner and the petitioner is in custody since 16.04.2016.

Heard learned A.P.P. also, who has opposed the prayer for bail, stating that the petitioner has criminal antecedent also. Having heard both sides and in view of the fact that there

No.10194 of 2017 (3) dt.23-03-2017 2/2 are allegations under Section Criminal Law Amendment Act also as well as the petitioner is accused in six other cases also, as such, I am not inclined to grant bail to the petitioner, however, as the petitioner is in custody, the learned trial court is directed to expedite the trial of the petitioner and if possible conduct it on regular basis and try to conclude the same preferably within a period of one year.

At the same time, The Sr.S.P., Gaya is directed to ensure presence of the witnesses regularly so that the trial of the case may be concluded within the period as specified.

With the aforesaid observation, this application is dismissed.
