1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 30(a), 32(3), 36, 41(1) of the Bihar Prohibition and Excise Amendment Act, 2016.

3. As per allegation in the F.I.R., it is a case of recovery of 2637 litres of foreign liquor from a container.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in this case due to several criminal antecedents. It is further submitted by learned counsel for the petitioner that nothing has been recovered from the possession of the petitioner and he has not apprehended on the spot. The petitioner is languishing in

Patna High Court CR. MISC. No.65116 of 2023(2) dt.12-10-2023 2/2 judicial custody since 14.06.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise-1, Samastipur in connection with Kalyanpur P.S. Case No. 77 of 2022.
