ANJANA PRAKASH ORAL ORDER 05-02-2015 The Petitioner seeks quashing of the order dated 20.7.2011, by which the Additional Sessions Judge-II, Bhagalpur has cancelled the bail of the Petitioner in Cr.Misc.No.208 of 2009. In the facts of the case, the petitioner above named is directed to be released on bail on furnishing bail bond of Rs. 5,000/-(Five thousand) with two sureties of the like amount each or any other surety to be fixed by the court concerned to the satisfaction of learned A.C.J.M., Naugachia, Bhagalpur in connection with Gopalpur (Rangra) P.S. Case No.386 of 2009, subject to the conditions (i) That one of the bailor will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will undertake to furnish information to the Court about any

(ii) That the Petitioner shall every month file a certificate that he has deposited Rs.2000/- till such time as it is revised and thereafter the revised amount as enjoined by the Principal Judge in a proceeding under Section 24 of the Hindu Marriage Act and if he refuses to do so on two consecutive months without any reasonable cause his bail bond shall once again cancelled.
Application stands allowed.
