JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-02-2020 Earlier the prayer for bail of the petitioner has been rejected twice by this Court vide order dated 03.03.2015 passed in Cr.Misc.No. 49373 of 2014 and vide order dated 27.06.2018 passed in Cr.Misc.No. 31720 of 2018.

Petitioner seeks regular bail in connection with Patna P.S. Case No. 20 of 2014 in Special Case No. 27 of 2014 registered for the offence punishable under Sections 414, 420, 467, 468, 471, 472, 34 of the Indian Penal Code and 20(B)(I), 23 and 29 of N.D.P.S. Act, 1985.

As per FIR, allegation against the petitioner is that 1 quintal of ganja was recovered from the truck which was allegedly been driven by the petitioner.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.79792 of 2019(4) dt.24-02-2020 2/2 that the petitioner is merely the driver of the truck from which the alleged recoveries were made. He has no knowledge of ganja recovered. He is in custody since 30.03.2014 and till date Trial has not yet concluded.

Heard learned A.P.P. for the State.

Considering the quantity of ganja recovered, I am not inclined to grant regular bail at this stage. However, the petitioner is custody for nearly six years, learned trial court is directed to expedite the trial to conclude tat the earliest preferably within a period of six months.

Accordingly, this application is dismissed.
