JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with S.Tr. No.34 /17arising out of Chapra Town P.S. Case No.410/16 registered under Sections 302/345 of the Indian Penal Code. The accusation is of quarrel in between the husband of the informant and the six F.I.R. named accused including the petitioner for partition of Jajmanika and causing injury by the petitioner through knife at the neck of husband of informant who died.

Learned counsel for the petitioner submits that it would appear from the F.I.R.. that there is no eye witness to the

Patna High Court Cr.Misc. No.13136 of 2017 (3) dt.19-04-2017 2/2 occurrence. In course of investigation Suraj Kumar Pandey, son of the informant gave his statement before police as an eye witness of occurrence due to old strand relation between informant's family and accused petitioner. The petitioner has no criminal antecedent and is in custody since 23.9.2016.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned 9th Additional Sessions Judge, Saran, Chapra, in S.Tr.No.34/17 arising out of Chapra Town P.S.Case No.410/16.
