This is an application for anticipatory bail for the offence punishable under sections 341, 323, 498 (A), 494 and 406/34 of the I.P.C.

The informant was married with the petitioner six years ago and the petitioner arranged second marriage with one Radha Devi after leaving the informant and again he has married with Rina Kumari and is living at Biharsharif being employed in Bihar Home Guard. Whenever the informant is making complaint she was being beaten up and tortured by the petitioner and others. Submission is that the petitioner is employed in Bihar home Guard and posted at Patna. He is still ready to live as

Patna High Court Cr.Misc. No.19286 of 2014 (5) dt.16-01-2015 2/2 husband and wife with honour and dignity. Allegation of remarriage with other lady was totally wrong and denied and as such the petitioner deserves sympathetic consideration to which the learned A.P.P. opposes by pointing out that there is allegation for marrying with another lady.

The petitioner is husband of the victim and allegedly he arranged marriage with two more girls which itself is cruelty to the informant and as such in the facts and circumstances this Court is not inclined to grant privilege of pre-arrest bail to the petitioner. Accordingly, his such prayer stands rejected in connection with Rajgir P.S. Case No. 62 of 2013 pending in the court of C.J.M. Nalanda at Biharsharif.
