The petitioner's grievance is that despite having retired from service after attaining the age of superannuation on 31.05.2013, part of his retiral dues such as arrears of C.P.F., Gratuity, Leave Encashment, difference of 5th and 6th pay revision as well as arrears of difference of salary for the promoted post from the period commencing from January, 1995 up-to May, 2013 and other benefits, have not been given to the petitioner.

The petitioner claims that he has filed a representation before the Deputy Development Commissioner-cum-Chief Executive Officer, Zila Parisad, Vaishali at Hazipur vide Annexure-4 dated

Patna High Court CWJC No.13020 of 2015 dt.05-05-2016 2/2 6.07.2015 but still nothing has been paid thereafter. Learned counsel appearing for the Zila Parishad, Vaishali, Hajipur has submitted that due to crunch of fund, the payment could not be made but the fund is likely to be received in the end of this month, thus, the payment of admitted dues can be made thereafter. Accordingly, this writ application is being disposed of with a direction to the respondent no.3, i.e., Deputy Development Commissioner-cum-Chief Executive Officer, Zila Parisad, Vaishali at Hazipur to immediately calculate the admitted dues of the petitioner and since funds are to be received by the end of this month itself, the entire admitted dues of the petitioner should be paid by the end of August, 2016.
