The petitioner seeks bail in Kamtaul P.S. case No. 3 of 2017 under Section 392 of the Indian Penal Code. The informant lodged the case for robbing his motor cycle, purse, bag and Rs. 3000/- on the point of pistol. The learned counsel for the petitioner submits that petitioner is a student of Intermediate. The case has been compromised. Of course, the motor cycle was recovered from the house of the petitioner but true facts are that the informant borrowed money from the petitioner and that is why the informant himself pledged his motor cycle with the petitioner as security but from the facts it appears that firstly Gautam Kumar was apprehended and from his possession looted purse was recovered.

Patna High Court Cr.Misc. No.10007 of 2017 (3) dt.23-03-2017 2/2 In pursuance of the confessional statement of Gautam Kumar house of the petitioner was searched and from there looted motor cycle was recovered.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Jha, J) BKS/- U T
