JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-01-2020 Petitioner seeks bail in connection with Bakhtiyarpur P.S. Case No. 199 of 2018 registered for the offences punishable under Sections 304B, 201 and 34 of the Indian Penal Code. Petitioner happens to be husband of the deceased and case is of dowry death with allegation that there was continued torture with respect to demand of dowry.

Submission of learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and other accused persons and nothing specific has been alleged against him and he is in custody since 13.5.2019. Heard learned APP, who has opposed the prayer for bail on the ground that FIR as well as material collected during investigation disclosed that deceased was tortured and assaulted

Patna High Court CR. MISC. No.58238 of 2019(3) dt.08-01-2020 2/2 and she has informed about the same to her parents and thereafter her Maike people came and her dead body was found traceless and death is within seven years of marriage. In view of above facts and circumstances, I am not inclined to grant bail to the petitioner.

Accordingly, this application is dismissed.
