The petitioners have prayed for regular bail in a case registered for the offence punishable under sections 379 of the Indian Penal Code.

As per prosecution case, the allegation against unknown miscreants is that they have stolen 10,000/- cash kept in purse, bank cheques, silver coin weighing about 10 grams and other articles of the informant.

Learned counsel for the petitioners submit that the petitioners are innocent and have committed no offence. They have has falsely been implicated in this case merely on the basis

Patna High Court CR. MISC. No.61706 of 2023(2) dt.20-09-2023 2/2 of his self confessional statement which does not get evidientiary value in the eye of law. Neither the petitioners are named in the FIR nor they were put on TIP. It is further submitted that nothing stolen article has been recovered from their conscious possession. Moreover, the petitioners are languishing in judicial custody since 22.05.2023. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioners, this court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be released on bail in connection with Laheriasarai P.S. Case No. 671 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned concerned Court.
