1. Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel appearing on behalf of the complainant.

2. The petitioner seeks bail in a case registered for the offence punishable under Section 498(A) of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner, being the husband, has been falsely implicated in the instant case by the complainant. It is further submitted that petitioner is in custody since 16.07.2024 and is willing to keep the complainant with honour and dignity but then for reason best

No.63831 of 2024(2) dt.13-12-2024 2/2 known the complainant is not interested in continuing with the marital relationship on a false pretext that petitioner and his family members are demanding dowry of Rs.45 lakhs. It is further submitted that even the order impugned records that complainant does not intend to stay with the petitioner.

4. Learned counsel appearing on behalf of the complainant opposes the prayer for regular bail of the petitioner.

5. On query of the Court as to whether the complainant intends to stay with the petitioner or not on which learned counsel appearing on behalf of the complainant submits that complainant has already filed a divorce case in the Court of learned Principal Judge, Family Court, Patna being Divorce Case No. 1107 of 2024 which is pending adjudication. It is further submitted that complainant does not intend to stay with the petitioner.

6. After hearing the learned counsel for the parties, the provisional bail granted to the petitioner, vide order dated 06.09.2024, is hereby confirmed.
